City to Begin Review of Proposed Zoning Plan for Marijuana Retail, Cultivation, and Manufacturing Sites on Tuesday

The City unveiled a proposed zoning plan for recreational marijuana businesses, describing where sales, cultivation, and manufacturing can occur. Starting in November, Delaware will issue state licenses for marijuana sales and production. 

Wilmington will be establishing zoning restrictions before licenses are issued to prevent businesses from being set up without regulation. Mayor Mike Purzycki emphasized the importance of preventing marijuana businesses from being too close to neighborhoods and schools. 

Restrictions include: 

  • No marijuana licenses within 100 feet of residential districts or schools.
  • No retail marijuana establishment within 1,200 feet of another of the same type.
  • Marijuana cultivation and manufacturing are limited to manufacturing, heavy commercial, and waterfront areas.
  • Retail marijuana sales will be allowed in manufacturing, commercial, and certain mixed-use districts.

Additional state-level restrictions include:

  • No public marijuana use or consumption at licensed establishments.
  • Strict product testing for safety.
  • Sales to individuals under 21 remain illegal.
